Kas juhatuse koosolek saab ära muuta üldkoosoleku poolt vastu võetud otsust?Jutt sellest samast remondi fondist,et juhatus otsustas ära muuta 01 augusti 01 juuliks.
Ei, juhatus seda mitte teha ei saa, seda saab muuta ainult KÜ liikmete üldkoosolek. Juhatus allub üldkoosolekule, mitte üldkoosolek juhatusele. Juhatusel on võimalus oma otsusega sihtsissemakseid koguda, kui põhikirjas on nii sätestatud.

Siin on küll ühene tõlgendus. Otsuses on ju kirjas, et remondifondi kogutavat tõstetakse alates 01 augustist. See tähendab seda, et juuli arve, mis esitati augusti alul, oleks pidanud olema veel vana arvestusega. Ja augusti kuu kuluarve, mis esitatakse septembri alul on juba nö uue süsteemi arvestusega.
Antud situatsiini arvestades peaks juhatus ja/või raamatupidaja tegema järgmise arvega tasaarvelduse ja selgitava kirja juurde lisama.

Meil võeti koosolekul vastu, et edaspidi hakkame remondi fondi maksma ruut meetri pealt (enne oli kindel summa korteri pealt) ja protokollis oli kirjas,et 1 augustist ja nüüd tuli juuni kuu arve kus oli see juba lisatud.Kas ei peaks olema see augusti kuu arve peal ?
Kas esimesest augustist maksma või arvestama? Usun, et vastuse leiad protokolli sõnastusest.
